By accessing our website, at www.vetsprevail.com, you signify that you have read, understand, and agree to be bound by these Terms of Use whether or not you are a registered client of Prevail Health Solutions LLC. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of Vets Prevail and www.vetsprevail.com after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future terms, do not use or access, or continue to use or access Vets Prevail or www.vetsprevail.com. It is your responsibility to regularly check these Terms of Use and to review any changes.

Eligibility

Vets Prevail membership is void where prohibited. Vets Prevail is intended solely for users who are eighteen (18) years of age or older. Any registration by, use of, or access to Vets Prevail by anyone under 18 is unauthorized, unlicensed, and in violation of these Terms of Use. By using Vets Prevail, you represent and warrant that you are eighteen (18) years of age or older, and that you agree to and shall abide by all terms and conditions of these Terms of Use.

Account Security & Registration Data

In consideration of your use of Vets Prevail, you agree to and shall:

  1. provide accurate, current, and complete information about you and your emergency contacts as prompted by any registration forms on the Vets Prevail website;
  2. maintain the security of your password and identification;
  3. maintain and promptly update your registration and any other information you provide to Prevail Health Solutions, keep it accurate, current, and complete; and
  4. be fully responsible for all use of your account and for any actions that take place using your account.

Prevail's Proprietary Rights in Site Content

All content on www.vetsprevail.com and the Vets Prevail intervention including text, graphics, designs, pictures, video, information, software, music, sound, and their selection and arrangement ('content') are the proprietary property of Prevail Health Solutions LLC, or its licensors with all rights reserved. No content may be modified, copied, distributed, framed, reproduced, republished, downloaded, transmitted, or sold in any form by any means, in whole or in part, without the company's prior written consent.

Any use of Vets Prevail or www.vetsprevail.com other than as specifically authorized herein, without the prior written consent of Prevail Health Solutions is strictly prohibited and will automatically terminate the usage granted herein. Such unauthorized use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This usage is revocable at any time without notice and with or without cause.

Trademarks and Service Marks

Prevail and Vets Prevail and other company graphics, logos, designs, page headers, icons, scripts and service names are the trademarks and service marks, or trade dress of Prevail Health Solutions. Prevail Health Solutions' trademarks and trade dress may not be used in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used in whole or in part without prior written consent from Prevail Health Solutions.

User Conduct

Vets Prevail and www.vetsprevail.com are available for personal, non-commercial use only. You represent, warrant, and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through Vets Prevail will infringe upon the rights of any third party, including but not limited to copyright, trademark, privacy, publicity, or other personal or proprietary rights or contain libelous, defamatory or otherwise unlawful material.

Prohibited Actions include, but are not limited to:

  1. Use of Vets Prevail or www.vetsprevail.com in any unlawful manner or in any other manner that could damage, disable, or overburden or impair Vets Prevail or www.vetsprevail.com.
  2. Use of automated scripts to collect information from or otherwise interact with Vets Prevail or www.vetsprevail.com.
  3. Sharing, posting, or otherwise making available any content that Prevail Health Solutions deems to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, pornography, fraudulent, invasive of privacy or publicity rights, hateful, or racially or ethnically objectionable.
  4. Registration of more than one account per person. You may not register for an account on behalf of an individual other than yourself, and you may not register on behalf of any entity.
  5. Posting or sharing private information of any third party, including addresses, phone numbers, email addresses, social security numbers, or credit card numbers.
  6. Solicitation of any personally identifying information from Prevail Health Solutions Mentors or Trainers.
  7. Posting, sharing, transmitting, or otherwise making available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  8. Posting, sharing, transmitting, or otherwise making available any material that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national, or international law.
  9. Using or attempting to use another's account, or creating a false Vets Prevail Identity.

Account Termination

In accordance with the Digital Millennium Copyright Act (DCMA) and other applicable law, Prevail Health Solutions has adopted a policy of terminating, in circumstances solely at Prevail Health Solutions' discretion, users who commit any or all of the prohibited acts contained in these Terms of Use.

Third Party Websites and Content

The website www.vetsprevail.com contains links to other websites (Third Party Sites). Such Third Party Sites are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by Prevail Health Solutions, and we are not responsible for any Third Party Sites accessed through www.vetsprevail.com.

User Dashboard

The user dashboard is used solely for self-help and communication purposes. The information you provide to Prevail Health Solutions during your Vets Prevail registration will supply information for your user dashboard. By using Vets Prevail, you certify that all information provided to Prevail Health Solutions in registration for Vets Prevail is correct and accurate. You may not set up an account on behalf another individual or entity.

Disclaimers

Vets Prevail and www.vetsprevail.com may be temporarily unavailable from time to time for maintenance and other reasons. Prevail Health Solutions assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication failure, or alteration of user communications. Prevail Health Solutions is not responsible for any technical malfunction or other problems of any telephone network service, computer systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any site or combination thereof, including injury or damage to a user's computer or other hardware or software related to or resulting from using or downloading material in connection with Vets Prevail or www.vetsprevail.com. Prevail Health Solutions is not responsible for any loss or damage, including personal injury or death, resulting from anyone's use of www.vetsprevail.com and Vets Prevail.

Vets Prevail is a voluntary method for self-help. Participants understand that they are participating in the Vets Prevail voluntary trial program. Vets Prevail is not a method of emergency crisis management and is not intended to replace your current methods of physical and mental health care. In the event of an emergency, immediately call 911 or a veteran assistance hotline such as 1-866-554-IWAP (4927). The site www.vetsprevail.com and Vets Prevail are provided 'as is' and 'where is' and Prevail Health Solutions disclaims any and all representations and warranties, whether express or implied, including implied warranties of title, merchantability, fitness for a particular purpose or non-infringement. Prevail Health Solutions does not guarantee and does not promise any specific results from use of Vets Prevail. By using www.vetsprevail.com and/or Vets Prevail, you accept the terms contained in this disclaimer. You agree that any use you make of such services, advice, or answers is at your own risk and that Prevail is not responsible for any damages or losses resulting from your reliance on information contained in the Vets Prevail intervention. Prevail Health Solutions does not represent or warrant that software, content, or materials included in Vets Prevail and on www.vetsprevail.com are accurate, complete, reliable, current, or error-free or that the site or Vets Prevail is free of viruses or other harmful components. Submissions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information about Vets Prevail and/or www.vetsprevail.com, are voluntarily provided by you to Prevail Health Solutions LLC, are non-confidential, and shall become the sole property of Prevail Health Solutions LLC. The company shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these submissions for any purpose, commercial or otherwise, without acknowledgement or compensation to you.

Cancellation of Account

If you decide to discontinue your use of Vets Prevail and would like to cancel your registration, you must email support@prevailhs.com, include your name and request a cancellation of account.

Entire Agreement

These Terms of Use constitute the entire agreement between you and Prevail Health Solutions regarding the use of www.vetsprevail.com and/or Vets Prevail. The failure of Prevail Health Solutions to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision in that or any other instance. If any provision of these Terms of Use is held invalid, the remainder of these Terms of Use shall continue in full force and effect. If any provision of these Terms of Use shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
